Terms of Service

1. Agreement

These Terms of Service (the "Terms") govern your use of A La Carte (the "App"), a mobile application published by Miredain LLC ("Miredain," "we," "us," or "our"), a single-member limited liability company formed in California, United States.

By creating an account, signing in, or otherwise using the App, you agree to these Terms and to the A La Carte Privacy Policy. If you do not agree, do not use the App.

These Terms are specific to A La Carte and govern it. Miredain LLC also publishes general terms covering its website and its products as a whole; where those and these differ, these Terms control for the App.

These Terms replace the A La Carte Terms of Service dated May 13, 2026.

2. The App

A La Carte helps you save, generate, organise, plan meals from, and shop for recipes. Its features include importing recipes from websites, social-media posts, and photographs; generating recipes and suggestions using artificial intelligence; tracking a pantry; building grocery lists; guided cooking; and flagging ingredients against the dietary preferences you record.

We may add, change, or remove features. If we remove a material feature of the paid subscription, we will give reasonable notice.

3. Food safety, allergies, and dietary information

This is the most important section of these Terms. Please read it.

A La Carte is not a food-safety tool and is not a substitute for reading labels or for professional medical advice.

Allergen flags, dietary classifications, ingredient substitutions, and nutrition figures in the App are generated automatically — often by artificial intelligence, and often from recipes written by third parties. They may be wrong, incomplete, or out of date. An ingredient that triggers your allergy may not be flagged. A recipe labelled as meeting a dietary restriction may not meet it.

You are solely responsible for verifying the actual ingredients of anything you prepare or eat, for reading the packaging of every product you buy, and for consulting a qualified medical professional about any allergy, intolerance, medical condition, pregnancy, or dietary requirement. Never rely on the App alone to decide whether a food is safe for you or for anyone else.

To the maximum extent permitted by law, Miredain LLC disclaims all liability for any allergic reaction, illness, injury, or other harm arising from reliance on dietary, allergen, or nutritional information shown in the App.

Nothing in this section limits any liability that cannot be limited by law, including liability for death or personal injury caused by our negligence.

4. Artificial intelligence

A La Carte uses third-party artificial-intelligence models to generate recipes, extract recipes from webpages, images, and video, transcribe audio, analyse dietary information, and make suggestions.

Output produced by these models is computer-generated. It may be inaccurate, incomplete, nonsensical, or unsuitable, and it is not professional culinary, nutritional, or medical advice. Cooking times, temperatures, and quantities in a generated recipe may be unsafe if followed without judgement. Treat every AI output as a draft you are responsible for evaluating before you rely on it.

To provide these features, content you supply — such as a recipe, a link, an image, or your dietary preferences — is transmitted to an AI provider to produce a result for you. Your content is not used to train artificial-intelligence models.

5. Eligibility

You must be at least 13 years old to create an account, or 16 if you are in the European Economic Area and local law sets that age. If you are under 18, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf and supervises your use of the App.

6. Your account

You are responsible for the accuracy of your account information, for keeping your credentials confidential, and for activity under your account. Tell us at support@alacarte.recipes as soon as you suspect unauthorised access.

You may delete your account at any time from Profile → Account Settings → Delete Account.

7. Importing recipes and third-party content

The App can import recipes from websites, social-media platforms, and photographs of printed material.

Content you import remains the property of whoever created it. Recipe ingredient lists are generally not protected by copyright, but the surrounding text, narrative, photographs, and video usually are. You are responsible for ensuring you have the right to import and use any content you save, and for using imported content for your own personal, non-commercial cooking.

We do not endorse, verify, or take responsibility for third-party content, and we are not responsible for the availability of any third-party platform. Import features depend on services we do not control and may stop working without notice.

8. Subscriptions, billing, and cancellation

Some features require A La Carte Plus, an auto-renewing subscription.

Free trials. Where a free trial is offered, it converts to a paid subscription at the end of the trial period unless you cancel before then. Trial eligibility is generally limited to one per person.

Price changes. We may change the subscription price. We will give notice before a change affects you, and you may cancel before it takes effect.

9. Your content

You own your content — the recipes, photographs, notes, meal plans, lists, and other material you create or upload ("Your Content"). These Terms transfer no ownership of it to us.

You grant us a worldwide, non-exclusive, royalty-free licence to host, store, process, transmit, and display Your Content solely to operate the App for you. That licence ends when you delete the content or your account, except for copies in backups until they cycle out.

We do not sell Your Content, and we do not use it to train artificial-intelligence models. We access it only to operate the App, to address a technical or security problem, to respond to your support request, where the law requires it, or where you permit it.

You are responsible for Your Content and represent that you have the rights necessary to provide it.

The App — its software, design, branding, and the content we provide — belongs to Miredain LLC or its licensors. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for your own personal, non-commercial purposes. Our names and logos may not be used without our written permission.

12. Copyright complaints

If you believe content in the App infringes your copyright, email support@alacarte.recipes with: your signature; identification of the work; identification of the material and where it appears; your contact details; a statement of good-faith belief that the use is unauthorised; and a statement, under penalty of perjury, that your notice is accurate and you are authorised to act for the owner.

We will investigate, may remove material, and may terminate the accounts of repeat infringers.

13. Feedback

If you send us ideas or suggestions, you grant us a perpetual, irrevocable, royalty-free, worldwide licence to use them without restriction or compensation. Please do not send anything you consider confidential.

14. Availability

We work to keep the App available and functioning, but we do not promise uninterrupted or error-free operation. Availability may be affected by maintenance, third-party outages, platform changes, and other events. We do not offer a service-level agreement or service credits.

15. Termination

You may stop using the App at any time and delete your account from within it.

We may suspend or terminate your access if you breach these Terms, if your use presents a legal or security risk, or if we discontinue the App. If we discontinue it, we will give reasonable notice and, where you have prepaid for a period you can no longer use, a pro-rata refund of that unused period where we are able to issue one.

On termination your licence ends and Your Content may be deleted after a reasonable period. Sections 3, 4, 9, 11, 13, and 16 through 21 survive.

16. Disclaimer of warranties

To the maximum extent permitted by law, the App is provided "as is" and "as available," without warranty of any kind, whether express or implied, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Miredain LLC does not warrant that the App will be uninterrupted, secure, or error-free, that defects will be corrected, that import or AI features will work with any particular source, or that any recipe, dietary classification, or nutritional figure will be accurate.

Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you. Nothing here limits a warranty or right you have that cannot be limited by law.

17. Limitation of liability

To the maximum extent permitted by law, Miredain LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the App.

Cap on total liability. Our total liability arising out of or relating to these Terms or the App will not exceed the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) one hundred US dollars (US$100).

These limits apply regardless of the legal theory and even if we were advised the damage was possible. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Nothing in these Terms excludes or limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot be excluded by law.

18. Indemnification

You agree to indemnify and hold harmless Miredain LLC and its officers, members, employees, and agents from any claim, liability, damage, loss, or expense (including reasonable legal fees) arising from your breach of these Terms, Your Content, content you import, or your misuse of the App. We may assume the exclusive defence of any such matter, and you will cooperate with us.

19. App store terms

Where you obtain the App through a third-party app store, the following apply in addition to these Terms.

20. Governing law and disputes

Governing law. These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. This does not deprive you of the protection of mandatory consumer-protection law in your country of residence.

Talk to us first. Before starting a formal proceeding, email support@alacarte.recipes describing the problem. If it is unresolved after 30 days, either of us may begin formal proceedings.

Arbitration. Except as stated below, you and Miredain LLC agree to resolve any dispute by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. This means you and we each waive the right to a jury trial and to participate in a class action. Arbitration will take place in Alameda County, California, or — at your election — by telephone, by video, or on documents alone. Where the AAA rules require us to bear filing and arbitrator fees for consumer claims, we will. The Federal Arbitration Act governs this provision.

Exceptions. Arbitration does not apply to claims that qualify for small-claims court, disputes about intellectual property, or a request for injunctive relief to stop unauthorised use of the App.

Opting out. You may opt out of arbitration within 30 days of first accepting these Terms by emailing support@alacarte.recipes with the subject line "Arbitration Opt-Out," stating your name and that you decline. Opting out affects no other part of these Terms, and we will not hold it against you.
